1. Scope of Agreement and Definitions
Scope of Application
This Agreement applies to all users of the Gudtrip Platform and Gudtrip Smart Vape devices. By connecting an email, phone number, or blockchain wallet, or by binding a device, the user is deemed to have agreed to this Agreement.
Territorial Restrictions – Physical Products vs. Digital Services
Gudtrip Smart Vape devices, and any other nicotine or cannabis-related consumable products (collectively, "Physical Products"), are intended solely for sale and shipment to jurisdictions where such products are permitted by applicable law. They are not offered for sale or shipment to locations where their sale, possession, or import is restricted or prohibited.
We do not accept orders for Physical Products that (a) list a shipping address in a jurisdiction where such sale or shipment is unlawful; or (b) are placed by a person who, at the time of ordering, resides in such a jurisdiction.
Individuals in jurisdictions where the sale of such products is restricted may access and use the digital-only features of the Gudtrip Platform, including the cashback program where eligible, provided that such use is legal in their jurisdiction and they meet the age, offer, and compliance requirements set forth in this Agreement.
By submitting any order for Physical Products, you represent and warrant that (a) your location and the designated shipping address are in jurisdictions where the sale, possession, and import of such products are lawful; and (b) you are legally permitted to purchase and receive them.
We reserve the right to cancel or refuse any order for Physical Products if we have reasonable grounds to believe that it would violate applicable territorial or legal restrictions.
Key Definitions
Cashback Program: Eligible users may receive cashback on qualifying purchases. Eligibility, cashback amounts, redemption requirements, and limits are described in the applicable offer. Cashback is based on qualifying purchases and is not earned by smoking or generating consumption data.
2. Cashback and Data Rules
Cashback Eligibility
Only qualifying Gudtrip purchases are eligible for cashback, subject to the applicable offer terms.
Users must not tamper with product tags or codes, submit duplicate claims, or otherwise misuse the cashback program. Claims may be reviewed for eligibility and fraud prevention.
Data Ownership and Usage
We may collect information you provide and information about your use of our services, such as account activity, device and browser information, and cashback transactions. We use this information to operate and improve our services, administer cashback, provide support, and help prevent fraud, as described in our Privacy Policy.
We may use aggregated or anonymized service-usage information for the following purposes:
Understanding how our website, app, and cashback program are used.
Improving service performance and the customer experience.
3. User Obligations and Restrictions
Compliance Commitment
Users must be 21 years of age or older and comply with the electronic cigarette and related substance regulations of their local jurisdiction.
You must not attempt to purchase or arrange shipment of Gudtrip Physical Products to any jurisdiction where such products are prohibited or restricted.
Individuals located in jurisdictions where the sale of Physical Products is restricted may use only the digital services offered by the Gudtrip Platform (including the cashback program where eligible) and must not place orders for Physical Products destined for locations where such transactions are unlawful.
4. Disclaimer
Nothing on the Gudtrip Platform or in the "Shop" section constitutes an offer to sell Physical Products in jurisdictions where such sale, shipment, or possession is not permitted. Any product listings and prices are directed exclusively to jurisdictions where such sales and shipments are lawful.
If cashback is delayed or a claim appears incorrect, contact Gudtrip customer support. Cashback availability and processing are subject to the applicable offer terms.
